1. Introduction to the ‘Pet of the Month’ competition

The organiser of this competition is Liebesgut Tiernahrungs GmbH & Co. KG, Stadtplatz 1, 95478 Kemnath, email address: shop@liebesgut-tiernahrung.de (hereinafter referred to as ‘Liebesgut’). The competition is not affiliated with Facebook or Instagram and is in no way sponsored, endorsed or organised by Facebook or Instagram.

2. Eligibility

Entry is free of charge.
The ‘Pet of the Month’ competition is open exclusively to dogs and cats. Unfortunately, other animal species cannot be considered.
Participants must have a public Instagram and/or Facebook profile and follow the Instagram page ‘liebesgut_tiernahrung’ and/or the Facebook page ‘Liebesgut Tiernahrung’.
Entry to the competition is possible via Instagram or Facebook and is made by posting a photo of your pet in the comments section beneath the competition post. The comment must also include the pet’s name. Only one photo of a pet may be submitted per comment/participant. Furthermore, participants may only enter the competition once every six months.
Entry is subject to the condition that the entrant accepts these terms and conditions and undertakes to comply with them.
The competition is open to anyone aged 18 or over.
Liebesgut reserves the right to exclude the participant(s) concerned from taking part without giving reasons in the event of breaches of these terms and conditions or if manipulation is suspected.
Liebesgut also reserves the right to amend, alter or cancel the competition at any time without giving reasons.
The start and closing dates of each competition will be announced in the relevant entry post. Entries received after the closing date stated there cannot be considered, regardless of the reason for the delay.
The winner will be determined on Facebook and Instagram in the comments section of the competition post. Users can vote for their favourite animal by liking the relevant photo comment. The participating animal photo with the most valid likes at the end of the voting period wins. The winner will receive a Liebesgut gift voucher worth €50, and their pet will be featured on Liebesgut’s social media channels. In addition, a shopping voucher worth €25 will be raffled off amongst all comments.
The winner must reply within 7 days of being notified of their win via a message on Instagram or Facebook. Once this period has expired, Liebesgut is entitled to select a new winner.
The decision is final; no cash alternative or exchange of the prize is permitted.
The prize is non-transferable.
Items purchased using the voucher cannot be exchanged.
The voucher can only be redeemed once. If it is used for an order under €50, the remaining balance will automatically lapse.

3. Photo requirements and rights

Only photos of dogs and cats may be submitted. Photos depicting violence against animals, or where violence against animals was committed in order to take the photo, are not permitted. The same applies to animal cruelty and inappropriate care, as well as to breaches of general ethical and moral standards and the anthropomorphisation of animals.
The photos must have been taken by the entrant themselves. The entrant must also hold all rights to the photo and grants Liebesgut the right to use the photo further.
The participant must ensure and guarantee that the photographs and their publication by Liebesgut do not infringe the rights of third parties, in particular trade marks or copyright.
AI-generated images, as well as heavily edited or altered photographs, are excluded from the competition. Liebesgut is looking for genuine, authentic photos of your pets.
The winner agrees to provide, following the announcement of the winner, the information required for the processing and presentation of the prize. This may include, in particular, photographs, the pet’s name, details for a profile, as well as the winner’s email address and postal address.

4. Transfer of Rights, Publication

The participant undertakes to transfer the copyright to the photos to Liebesgut free of charge. The transfer of copyright applies to all known areas of use; in particular, by uploading or posting the photos, the participant grants Liebesgut the right, without restriction in terms of time, location or content, to use the photos on the internet and in print publications without limitation.
The participant grants Liebesgut the unrestricted right to use the submitted image for advertising purposes and as part of the ‘Pet of the Month’ feature, even beyond the original context of the competition and across all media, including the internet and print publications.
Liebesgut is entitled to edit the photographs for the purpose of publication, to combine them with other content – in particular other photographs – and to publish the pet’s name and information about the pet in conjunction with the photograph. Liebesgut is also entitled to sub-license the rights granted by the participant.
The submission of photographs and the granting of rights to the photographs are made without compensation; Liebesgut owes participants no remuneration, irrespective of the use of the photograph, provided that such use is lawful and in accordance with these terms and conditions.
Participants have no right to have a photograph published.

5. Miscellaneous

Liebesgut accepts no liability whatsoever for the availability of the software or the continued ability to submit photos until the closing date for entries.
